Expungement is the process under the law where you may clear your prior record of certain arrests, convictions, or crimes and offenses and participation in diversionary programs.  Or, as defined in the law itself, expungement “shall mean the extraction and isolation of all records on file within any court, detention or correctional facility, law enforcement or criminal justice agency concerning a person’s detention, apprehension, arrest, detention, trial or disposition of an offense within the criminal justice system.”

Once an initial petition is filed the Court will assign a hearing date 60 days later so that any of the law enforcement agencies that must be notified have the ability to object or ask for changes to the petition.  The initial petition must be mailed certified, return receipt to the appropriate agencies.  Once the petition is approved and the order of expungement is signed by the Judge, that final petition must again be mailed, certified, return receipt to the same agencies who will then remove the offenses from your record.
